Indiana Foundation Repair Rules: What Fort Wayne, IN Homeowners Should Know
Foundation work on a house in Fort Wayne, IN touches rules from the State of Indiana and from Allen County, plus a City of Fort Wayne review for homes in local historic districts. This page sorts out the parts a homeowner is likely to meet, in plain words, so you know what to ask a contractor and which office to check with.
Key Points Up Front
Indiana has no statewide license for foundation contractors. The state leaves contractor licensing to cities and counties, and Allen County licenses contractors. In Allen County, foundation repair usually needs a permit. State law also sets ground rules for home improvement contracts and gives most homeowners a short window to back out. Ossian is in Wells County, which has its own office.
- Licensing is local. Allen County licenses the people and registers the businesses that do building work here.
- Permits go by the wall. The County's fee schedule lists foundation repair one wall at a time.
- Contracts over $150 go in writing. The contractor signs first, before you add your name, and any later change should be written and signed too.
- Keep the deposit modest. Keep any down payment to one-third of the total or less, the Attorney General's office advises. That is state consumer advice, not a law that binds every job.
This is a summary of public law, not legal advice.
Does Indiana License Foundation Contractors?
Not at the state level. The Indiana Attorney General's consumer flyer says licensing requirements differ from community to community and tells homeowners to check with their city or county building department. In short, Indiana leaves contractor licensing to cities and counties, and Allen County is one of the places that does license.
The County's rules say every contractor and subcontractor working in Allen County must hold a County license. Individuals carry the license, while a business holds a Building Department registration and names a license holder who answers for its work. Structural classes include General Contractor, Building Contractor, Residential Contractor and Home Improvement Contractor, the last covering repairs and remodeling of existing one- and two-family homes but not additions. Concrete and masonry have subcontractor licenses. "Foundation" is not a license class.
Allen County requires contractors to be licensed and registered with the Allen County Building Department. Ask the specialist for its registration, and check it in the County's Citizen Access portal or by calling the Building Department at 260-449-7131.
The City of Fort Wayne and New Haven both rely on that department. In Huntertown and Leo-Cedarville, check with the Building Department for your address. Ossian is different: its contractor questions go to the Wells County Area Plan Commission.

Does Homeowners Insurance Cover Foundations?
We can't answer that for your house, and no general rule can. Only your own policy and your insurer can say. Read the policy and ask your insurer before any work starts.
Undoing a Contract, Legally
Indiana's Home Improvement Contract Act builds in a pause after you sign. In most cases you have until midnight of the third business day after signing to walk away from a home improvement contract. The contract has to include a cancel notice you can detach and return, so look for it before you sign and keep a copy of anything you send.
The same law wants contracts over $150 in writing. A sound contract names you and the contractor with both addresses, describes the work, gives start and finish dates and the price, and carries the contractor's signature before yours. No down payment should change hands before that.
A second state law, the Deceptive Consumer Sales Act, bars a seller from pretending to a sponsorship, approval or affiliation it lacks, from telling you a repair is needed when it isn't, and from promising to finish by a date it can't meet. Complaints about a contractor go to the Attorney General of Indiana, whose Consumer Protection Division takes them at 1-800-382-5516. This is general information, not legal advice.
Permit and Engineering Requirements
In Fort Wayne and across the rest of Allen County, a foundation repair job usually calls for a permit from the Allen County Building Department. Its fee schedule lists foundation repair by the individual wall, and its Residential Permit Guide counts structural alterations as permit work. Piers, wall braces and leveling aren't named one by one, so ask the specialist who pulls the permit. The County works from the 2018 edition of the Residential Code.
An owner who lives in the home may pull a permit for work on that primary residence, as long as no subcontractors are hired; the affidavit is filed in person with a state ID. Otherwise, permits go only to applicants who hold a County license or registration.
Ask whether a licensed professional engineer will evaluate the repair. The County wants a letter stamped by an Indiana-licensed architect or engineer, with a description of the damage and a step-by-step repair plan, in certain cases: structural storm damage, fire or vehicle damage, work done without permits or inspections, and work that would depart from current code. Routine foundation repair isn't on that list, so ask whether your repair needs one.
- Historic districts. If your home is in a Fort Wayne local historic district, the permit is routed for a Certificate of Appropriateness review. Building Department staff can't issue a permit that needs that review, so ask the specialist and the City's Historic Preservation staff.
- Floodplains. A home in a mapped floodplain may face an extra step; ask the Allen County Surveyor's Office, which handles floodplain permits.
- Plumbing tie-ins. Connecting an interior drain or a sump line to the building drain is plumbing work, and Indiana requires a licensed plumbing contractor for it. Ask who handles any plumbing connection.
Permit Offices Near Fort Wayne
The right office depends on the address, not the mailing city. Most foundation repair is building-code work rather than zoning, but the zoning offices are listed so you know where they fit.
- Allen County Building Department. 200 East Berry Street, Suite 180, Citizens Square, Fort Wayne. It issues building permits for the City of Fort Wayne, for New Haven under that city's code, and for unincorporated Allen County. Its phone number is in the licensing section above.
- Allen County Planning Services. 200 East Berry Street, Suite 150. It handles zoning for the County.
- New Haven Planning Department. It handles zoning inside New Haven city limits.
- Wells County Area Plan Commission, for Ossian. 223 W. Washington St., Bluffton; 260-824-6407. Its county Improvement Location Permit applies to construction projects across Wells County outside one town's limits, which takes in Ossian. Check with the Commission on whether your repair needs a permit, and find out from the specialist who pulls it.

Legal Questions Homeowners Ask
Can I pull an Allen County permit for my own foundation work?
Often, yes. If you live in the house as your primary residence and hire no subcontractors, the County lets you file a homeowner affidavit in person with a state ID and pull the permit yourself. Once a contractor does the work, the permit goes to an applicant holding a County license or registration, so ask the specialist who will file it.
Do the Allen County licensing rules reach Ossian?
No. Ossian sits in Wells County, so the Allen County license and registration rules on this page don't carry over. Put two questions to the Wells County Area Plan Commission: what it asks of contractors, and whether your repair needs a permit there. Then ask the specialist who would pull any permit for the job.
Is a one-third deposit limit the law in Indiana?
It is advice, not a hard rule for every job. The Attorney General's consumer flyer suggests putting down no more than one-third of the total cost. Separately, state law says a home improvement contract over $150 belongs in writing and that no down payment should be taken before the contractor signs it.
My house is in a Fort Wayne local historic district. What changes?
Your building permit takes an extra route. Since November 7, 2025, permits for homes in those districts are sent for a Certificate of Appropriateness review before they can be issued. Ask the specialist how that affects the plan, and check with the City's Historic Preservation staff about your address.
